Firm size is not regulated. However, reality shows that USCIS applies more stringent standards to small and medium business. USCIS may ask questions about a company's finances and its ability to pay the beneficiary. For a company with an too small office or has a mere presence in the United States, the likelihood of USCIS refusal is higher.

Company in the US: Business must be obtained through opening a representative office, or by acquiring a business or company operating in the United States. At the same time must prove the relationship between the Vietnamese company and the US company

Depending on the investor's business plan, most L-1 visas are initially granted with a term of 1-3 years, so the investor needs to extend the L1 Visa. At this stage, the USCIS will consider whether the company operating in the US meet the conditions of the L1 visa or not.

Conversion to EB1-C green card (10-year green card)
After at least 1 year of operation, L-1 green card holders can apply for EB1-C immigration. Requirements for applying for an EB1-C green card are:
• The applicant has worked for a Vietnamese company and a US company as a manager/executive.
• Has more than 10 full-time employees, of which 4 of them have university degrees.
• Business is not operating at a loss
